Initial policy requests
The Committee’s proposals do not concern only the application of the Article 15-bis compensation mechanism. They are part of a broader request to restore legal certainty, proportionality and constitutional guarantees for private investments made in the Italian photovoltaic sector on the basis of public rules and commitments.
1. Business sustainability assessment
Compensations should consider liquidity, business continuity and regulatory obligations.
2. Differentiated treatment
Small and medium-sized producers should not be treated as equivalent to large utilities and investment funds.
3. Suspension or rescheduling in critical cases
Documented critical cases require practical remedies.
4. Protection of mandatory obligations
Amounts required to meet maintenance, financing, RAEE, CCI, insurance and regulatory obligations should not be absorbed by automatic compensations.
5. Institutional table
A structured dialogue with MASE, GSE, ARERA and Parliament is required.
6. Recognition of the value returned to the country
Any analysis of incentives should also consider lower gas imports, lower emissions, energy security and the contribution of photovoltaic generation to wholesale electricity prices during solar hours.
7. Restoration of legal certainty and constitutional principles
The Committee asks for an institutional review of the rules and decrees that have affected the solar sector over the years, in order to realign the measures adopted with constitutional principles of equality, reasonableness, freedom of economic initiative, protection of property and investments, ability to pay, proportionality of levies, good administration and impartiality.
By “restoration of legal certainty”, the Committee refers to a framework in which investments made on the basis of contracts, incentives and public rules cannot be progressively compressed by subsequent, selective and layered measures without a concrete assessment of their impact on business continuity and legitimate expectations.
